Educator Portal Terms of Service

The Educator Portal is a service offered exclusively to educators by the California Environmental Legacy Project and its non-profit business auxiliary The Environmental Legacy Project (“The Legacy Project,” “we” or “us”) and hosted as a secure password protected area of The Legacy Project’s website (“Site”).

By using the Educator Portal (“Portal”), you agree to the Terms of Service (“TOS”) contained herein, as well as to the additional Terms of Service for the public Site, and to use the Portal in accordance with these TOS and any additional terms and conditions that are referenced herein or that otherwise may apply to specific sections of the Portal, or to materials and services that we make available to you through the Portal (all of which are deemed part of these TOS). Accessing the Portal, in any manner, whether automated or otherwise, constitutes use of the Portal and your agreement to be bound by these TOS.

We reserve the right to change these TOS or to impose new conditions on use of the Portal, from time to time, in which case we will post the revised TOS on this Portal and update the “Last Updated” date to reflect the date of the changes. By continuing to use the Portal after we post any such changes, you accept the TOS, as modified.

We reserve the right to deny access to the Portal or any features of the Portal to anyone who violates these TOS or who, in our sole judgment, interferes with the ability of others to enjoy our Portal or infringes the rights of others.


Information and content available through the Portal is restricted to use by educators and for exclusive non-commercial use in educational settings only.  Access to the Portal is granted in our sole discretion based on affiliation with an educational institution.  Educational institutions include but are not limited to academic institutions (e.g., elementary, junior and high schools, and universities), educational organizations, nature/science centers, and museums.  Educational use is for the sole purpose of illustration for instruction, and may include but is not limited to educational settings such public schools, after-school programs, nature/science centers, or teacher professional development programs.  Confirmation of education affiliation occurs through a registration process and access to the Portal is granted at our sole discretion.

Use of Videos on the Education Portal

The five regional films (“Videos”) available on this Portal are provided solely on an “AS IS” and “AS AVAILABLE” basis.  You are encouraged to confirm the information contained herein.

Title and copyright to the Videos remains solely with David Scheerer.  You may stream the Videos for educational, non-commercial use only, provided that (a) you include without modification all copyright and other proprietary notices contained in the content, (b) you do not modify the content, (c) you do not use the content in a manner that suggests The Legacy Project or David Scheerer promotes or endorses your, or any third party’s causes, ideas, websites, products or services, and (d) you do not use the content in any way that is unlawful or harmful to any other person or entity.  No quotes from any material authored by the Legacy Project Team, or David Scheerer, may be used in any media without attribution to The Legacy Project or David Scheerer, as appropriate.

Except as expressly permitted on this Portal, you agree not to license, distribute, create derivative works from, transfer, sell or re-sell the videos, or any information, content or services obtained from this Portal. You are not permitted to use the materials on this Portal except as expressly set forth herein.

Any other use of the Videos or Content available through the Portal requires prior written permission.  For permission requests, please contact us by email at info(at)calegacy.org and enter “Permissions Request” in the subject line.

Username and Password

To access the Videos, Content and other features of the Educator Portal, you will need a username and password. You will receive user names and passwords through the Portal’s educator registration process. We reserve the right to reject or terminate the use of any username that we deem, in our sole discretion, offensive, inappropriate or violates these TOS.  You are responsible for maintaining the confidentiality of your password and account, and are responsible for all activities (whether by you or by others) that occur under your password or account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. We cannot and will not be liable for any loss or damage arising from your failure to protect your password or account information.

Suspension and Termination of Access

You agree that, in our sole discretion, we may suspend or terminate your password, account (or any part thereof) or use of the Portal, or any part of the Portal, and remove and discard any of your Submissions to the Site, at any time, for any reason, without notice. You agree that we will not be liable to you or any third-party for any suspension or termination of your password, account (or any part thereof) or use of the Portal, or any removal of any of your Submissions to the Portal. In the event that we suspend or terminate your access to and/or use of the Portal, you will continue to be bound by the TOS that were in effect as of the date of your suspension or termination.
